Acceptable Use Policy
1. Scope
This policy governs the display name and the destination you submit. It forms part of the Terms of Service. It applies from the moment you submit a takeover and for as long as your takeover is current.
2. Destinations that are not permitted
You must not use the Service to direct traffic to any destination that contains, advertises, sells, distributes, or materially facilitates:
- child sexual abuse material, or any sexual exploitation of, or sexualised depiction of, a minor;
- pornography, sexually explicit content, or sexual services;
- malware, spyware, ransomware, or other malicious code;
- phishing, credential harvesting, or impersonation of another service in order to deceive;
- scams, fraud, or deceptive commercial practices;
- fraudulent investment schemes, including deceptive token sales, high-yield investment programmes and similar funnels;
- forced, disguised or deceptive downloads;
- gambling or betting, including licensed gambling;
- the sale or supply of illegal or controlled drugs;
- the sale or supply of weapons, ammunition or explosives;
- terrorism, violent extremism, or their promotion, financing or glorification;
- hatred that promotes violence against, or discrimination of, people on the basis of a protected characteristic;
- gratuitous graphic violence or gore;
- other illegal goods or services;
- counterfeit or stolen goods;
- clear piracy or the infringing distribution of copyrighted works;
- unlawful disclosure of another person's private information, including doxxing;
- unlawful impersonation of a person or organisation.
3. What this policy does not prohibit
Lawful political, journalistic, religious, academic, satirical and campaigning speech is not prohibited by this policy merely because it is controversial, unpopular, partisan or offensive to some people.
Lawful informational content about cryptocurrency and other financial topics is not prohibited by this policy. Deceptive token sales, fraudulent schemes and scam funnels are prohibited, as fraud, not as a subject matter.
We aim to apply this policy to what a destination does, not to which side of an argument it takes.
4. Payment provider restrictions
Our payment providers impose their own restrictions, and some categories of activity require a provider's prior written approval before they may be paid for through that provider.
Any activity that would require such pre-approval may not use the Service unless JOTLYO Projects has actually obtained the required approval. At the date of this version no such approval has been obtained, so no activity requiring one is permitted.
5. Evasion
You must not attempt to obtain or keep approval for content that would not be approved on its merits. In particular you must not:
- serve different content to our systems than to ordinary visitors, whether by user agent, IP range, geography, timing or any other signal (cloaking);
- change what an approved destination serves after approval, in order to substitute content that would not have passed review;
- use an approved address as a hop to content that would not have been approved;
- interfere with, overload, or attempt to exhaust our safety checks or our capacity;
- submit takeovers through automation designed to defeat human verification or rate limits.
6. Enforcement
Where we reasonably consider this policy to have been breached, we may refuse a takeover before activation, pause or disable a takeover that is current, decline to accept further takeovers from the same source, and where appropriate report the matter to a payment provider, a hosting provider or a competent authority.
Disabling a takeover for breach of this policy may be done without a contractual refund, to the maximum extent permitted by applicable law. Mandatory statutory rights are unaffected.
We aim to act proportionately, and to distinguish a mistake from a deliberate abuse. Where the breach is a genuine error and can be corrected, we will usually say so before disabling anything.
7. Repeat abusers
We maintain a repeat-abuser policy. Where the same buyer repeatedly breaches this policy, or is the subject of repeated substantiated copyright complaints, we may decline to accept any further takeovers from that buyer.
A block is applied by a person reviewing the history, not automatically by the number of complaints received. A complaint alone does not make anyone a repeat abuser.
8. Reporting a breach
If you believe a destination breaches this policy, report it at /report, or write to heyjotlyo@gmail.com.
